Near-Death Experiences Now Found to Have Scientific Explanations: Scientific American

Seeing your life pass before you and the light at the end of the tunnel, can be explained by new research on abnormal functioning of dopamine and oxygen flow

Near-death experiences are often thought of as mystical phenomena, but research is now revealing scientific explanations for virtually all of their common features. The details of what happens in near-death experiences are now known widely—a sense of being dead, a feeling that one's "soul" has left the body, a voyage toward a bright light, and a departure to another reality where love and bliss are all-encompassing.

Approximately 3 percent of the U.S. population says they have had a near-death experience, according to a Gallup poll. Near-death experiences are reported across cultures, with written records of them dating back to ancient Greece. Not all of these experiences actually coincide with brushes with death—one study of 58 patients who recounted near-death experiences found 30 were not actually in danger of dying, although most of them thought they were.

Recently, a host of studies has revealed potential underpinnings for all the elements of such experiences. "Many of the phenomena associated with near-death experiences can be biologically explained," says neuroscientist Dean Mobbs, at the University of Cambridge's Medical Research Council Cognition and Brain Sciences Unit. Mobbs and Caroline Watt at the University of Edinburgh detailed this research online August 17 in Trends in Cognitive Sciences.

For instance, the feeling of being dead is not limited to near-death experiences—patients with Cotard or "walking corpse" syndrome hold the delusional belief that they are deceased. This disorder has occurred following trauma, such as during advanced stages of typhoid and multiple sclerosis, and has been linked with brain regions such as the parietal cortex and the prefrontal cortex—"the parietal cortex is typically involved in attentional processes, and the prefrontal cortex is involved in delusions observed in psychiatric conditions such as schizophrenia," Mobbs explains. Although the mechanism behind the syndrome remains unknown, one possible explanation is that patients are trying to make sense of the strange experiences they are having.

Out-of-body experiences are also now known to be common during interrupted sleep patterns that immediately precede sleeping or waking. For instance, sleep paralysis, or the experience of feeling paralyzed while still aware of the outside world, is reported in up to 40 percent of all people and is linked with vivid dreamlike hallucinations that can result in the sensation of floating above one's body. A 2005 study found that out-of-body experiences can be artificially triggered by stimulating the right temporoparietal junction in the brain, suggesting that confusion regarding sensory information can radically alter how one experiences one's body.

A variety of explanations might also account for reports by those dying of meeting the deceased. Parkinson's disease patients, for example, have reported visions of ghosts, even monsters. The explanation? Parkinson's involves abnormal functioning of dopamine, a neurotransmitter that can evoke hallucinations. And when it comes to the common experience of reliving moments from one's life, one culprit might be the locus coeruleus, a midbrain region that releases noradrenaline, a stress hormone one would expect to be released in high levels during trauma. The locus coeruleus is highly connected with brain regions that mediate emotion and memory, such as the amygdala and hypothalamus.

In addition, research now shows that a number of medicinal and recreational drugs can mirror the euphoria often felt in near-death experiences, such as the anesthetic ketamine, which can also trigger out-of-body experiences and hallucinations. Ketamine affects the brain's opioid system, which can naturally become active even without drugs when animals are under attack, suggesting trauma might set off this aspect of near-death experiences, Mobbs explains.

Finally, one of the most famous aspects of near-death hallucinations is moving through a tunnel toward a bright light. Although the specific causes of this part of near-death experiences remain unclear, tunnel vision can occur when blood and oxygen flow is depleted to the eye, as can happen with the extreme fear and oxygen loss that are both common to dying.

Altogether, scientific evidence suggests that all features of the near-death experience have some basis in normal brain function gone awry. Moreover, the very knowledge of the lore regarding near-death episodes might play a crucial role in experiencing them—a self-fulfilling prophecy. Such findings "provide scientific evidence for something that has always been in the realm of paranormality," Mobbs says. "I personally believe that understanding the process of dying can help us come to terms with this inevitable part of life."

One potential obstacle to further research on near-death experiences will be analyzing them experimentally, says cognitive neuroscientist Olaf Blanke at the Swiss Federal Institute of Technology in Lausanne in Switzerland, who has investigated out-of-body experiences. Still, "our work has shown that this can be done for out-of-body experiences, so why not for near-death-experience-associated sensations?"

The job of CEO at a 200 person company is pretty different from the life I had 6 years ago—just before Meebo launched. It’s a lot less about what I do and a lot more about how I enable others. In today’s world, if you zoom out to a very macro-level view, there are three things I do. 1. Strategy. 2. People. 3. Resource allocation.

Strategy

You always hear that part of a CEO’s job is to come up with the “strategy”. But what does that really mean? In my world it’s listen, synthesize and communicate.

Listening means listening to everyone. Blogs, your employees, the press, other entrepreneurs, venture capitalists, customers and users—anyone who might have an interesting or informative point of view on what your company does. Bandied together, those constituencies form your market.

Synthesizing means taking all those things you’ve been listening to, deciphering signal (10% of it) from noise (90% of it), and adjusting course based on new points of view or new information. It’s rare that you’ll gather the exact strategy you should follow from the signal, but put it together and apply your own secret sauce and you have your winner.

And finally you communicate the newly formed strategy (to the extent you’ve decided to adjust course) to the market – the same people you’ve been listening to. At the end of day, you are your company’s chief sales person. To investors, the press, recruits, customers and users. You need to convince all of these people you’ve been listening to that you heard them, you internalized it all, and you came up with the winning strategy.

Together, I call these three pieces The Strategy Funnel. You listen, you synthesize and communicate and then you start all over again, listening to the feedback after you’ve communicated.

People

So many things are happening on a daily basis that it becomes very hard to stay on top of it all. In fact, you really can’t. Rather, you rely on your team to truly own the pieces of the overall puzzle that they are responsible for. This requires lots of things, top among them is trust.

First, you need to make sure you have the right folks in the right positions. Beyond ensuring that their skills (both hard and soft) are right for the role, you need to make sure that they continue to scale into that role as it inevitably becomes more complex with the growth of the company. Someone who was great at 100 people may hit a wall at 160 people.

Second, you need to make sure that these people are empowered to run their parts of the show. A lot of this empowerment comes through information, which of course needs to be communicated in some way. Counterintuitive as it may seem, ensuring that communication lines are very high bandwidth within the company is one of the top things you can do to empower people. Well…that, and not be a micromanager.

Third, you need to make sure you’ve clearly communicated the mission to your folks. If your leadership team doesn’t understand the mission or strategy, then neither will their respective teams. Watch how quickly progress will grind to a halt without a clearly articulated strategy in place—it won’t be pretty.

Fourth, you are your company’s chief recruiter. If one of our teams needs me to sell a candidate, I’ll get on the phone day or night, weekday or weekend. Heck, I’ve even flown out to see a candidate or two if they’re someone super special. Your company lives or dies by its team, regardless of whether you’re 2 people or 200. Attract the absolute best and brightest to work with your team and you’re already winning.

Resource Allocation

As your company grows and leaders at your company come to run specific functions, each function will vie for the company’s resources to best achieve its goals. Let’s unpack that for a minute. Since you can’t know everything that’s happening within the company, and therefore rely on your leadership team to run their respective functions, how do you make sure everyone’s on the right track? You provide clear goals for them to achieve. You measure these goals through a set of mutually agreed upon metrics that they are working to attain. Often, they will have a bonus tied to the achievement of these goals. So not only is there a sense of professional pride with meeting goals, but a bonus is often on the line too. And since you’re already hiring fantastic people who are intrinsically motivated, these people will work very hard to achieve their own team goals and thusly, the company’s goals.

One of the ways folks work to achieve their goals is to draw resources from the company. Some services are often shared at the corporate level—recruiting, HR, facilities and financial analysis would be an example. Other services are often shared between teams. For example, the ads team is as dependent on our engineering team to provide them with enough engineers to build new ad products as is our consumer products team to build the (very cool) checkins service we’re working on at Meebo. The leaders of these teams, at some level, compete for these shared resources—the more they get—the more likely they are to meet their goals.

You, as the CEO, are the ultimate “disinterested third party” between each of these teams. You, more than anyone, are tasked to make certain that the overall company meets its goals—not just its revenue goals or product goals, but all of them! As such, you make the call on how resources are allocated between competing priorities within the company.

That’s the end of the formal programming. Strategy, People and Resource Allocation are the three things I really spend my time on. But before we part, just one more thing. You are human. You make mistakes. You get stressed. But at all times, be real! Your people and your market want to hear from you—they want to know you and know what you stand for. They can sniff bullshit a mile away. Don’t disengage with reality behind the CEO’s magic curtain—it’s all too easy. Keep it real.

GOP grumbles about jobs plan

House Republicans may pass bits and pieces of President Barack Obama’s jobs plan, but behind the scenes, some Republicans are becoming worried about giving Obama any victories — even on issues the GOP has supported in the past.

And despite public declarations about finding common ground with Obama, some Republicans are privately grumbling that their leaders are being too accommodating with the president.

“Obama is on the ropes; why do we appear ready to hand him a win?” said one senior House Republican aide who requested anonymity to discuss the matter freely. “I just don’t want to co-own the economy by having to tout that we passed a jobs bill that won’t work or at least won’t do enough.”

Even with the presence of so many GOP-friendly provisions in Obama’s plan — like trade agreements and small-business tax relief — some senior lawmakers are pulling back, wondering how the president will ensure his initiatives will not add to the nation’s debt.

“To assume that we’re naturally for these things because we’ve been for them does not mean we will be for them if they cause debt, if they [have] tax increases and if they take money from the free-enterprise sector, which creates jobs,” said Texas Rep. Pete Sessions, who heads up the House Republican campaign arm.

So as they try to grab smaller, passable measures from Obama’s jobs package, Republicans are also trying to strike their own balance between appearing open to bipartisan solutions and not giving the president an easy legislative victory that could tether them to his ownership of a bad economy.

Immediately after Obama’s speech on Thursday, Republican lawmakers said they liked some of what they heard in the president’s plan — identifying and eliminating unnecessary federal regulations and the free-trade agreements with South Korea, Colombia and Panama, which have been front and center on the Republican agenda for several months.

House Majority Leader Eric Cantor (R-Va.) said at an event at a cement mixing plant in Henrico, Va., that there were “lots of things” in Obama’s speech that “reflect the kind of things” that House Republicans want to pass. Cantor singled out small-business tax relief, certain infrastructure spending projects and trade deals.

“All [of] these are things we can work together [on] to build consensus,” Cantor said.

But that feeling wasn’t universal.

“I have great respect for everybody in Republican leadership,” Sessions said. “I found what the president said to be out of balance; … It’s fair to give any [proposal by the] president [a chance] out of respect to him, but also we need to look at the substance.”

Sessions, noting the president’s dismal approval ratings on the economy, said that he didn’t get the sense over the August recess that voters were frustrated with both parties’ efforts to revamp the economy. Of course, Congress enjoys even worse approval ratings than the president — but many Republicans are still placing their electoral bets on the public placing ownership of the economy squarely on the president in 2012.

“I know how to read,” Sessions said, referring to the polls, “but my sense is that I’m unhappy with us also, with the way we work together, the House and Senate. We’re not on a pro-growth agenda; we’re on a pro-tax and spend agenda. … The American people will judge us [on] the aggregate, not [on] specifics.”

Moving individual pieces of the jobs bill isn’t all Republican leadership is aiming to do. House Speaker John Boehner (R-Ohio), Cantor and Majority Whip Kevin McCarthy (R-Calif.) are also embarking on a 10-week crusade to cut federal regulation. During his appearance in Henrico last week, Cantor talked about helping construction companies by cutting regulations on cement and the regulation that forces companies who do business with the federal government to withhold 3 percent. Cantor said he wants the Obama administration to return to a “reasonable regulatory posture.”

“Of course, there’s skepticism; there’s healthy skepticism on behalf of our constituents who have said what we need to do is get government out of the way,” said Tennessee Rep. Marsha Blackburn. But Blackburn and other Republicans are taking a page out of the president’s playbook — insisting that job creation is an issue too sacred to befall the typical trappings of Washington partisanship. Die-hards, like Iowa Rep. Steve King, insist that it’s merely an earnest philosophical disagreement.

“This is Keynesianism, and I have been critical of his approach since the beginning,” King said, adding that he found nothing GOP friendly about the president’s tax-cut-heavy plan. “The difficulty I might have had would be if he had actually offered a proposal that took us back to free markets and back to real serious tax reform and real reduction of regulation.”

But even some of his most conservative colleagues, like tea party freshman Rep. Raul Labrador of Idaho, made the case that they are willing to work for a bipartisan agreement, pointing to former President Bill Clinton as a model.

“Take a page from Clinton — when you’re willing to come to the Hill and work with Republicans, it actually makes both sides look better. What he said [in his speech] was all or nothing,” Labrador said. “If he says all or nothing, we won’t be able to work together. But if he takes those things we’re willing to work on, we could have a breakthrough, and it would be good for him and his reelection.”

Illinois Republican Rep. Bobby Schilling agreed: “His demand of pass this bill now wasn’t taken very well, because how can you pass a bill when you don’t know what it’s got?”

Roubini: Without stimulus, another Great Depression

The slowdown in the world economy has accelerated the timing and likelihood of a new global financial crisis, gloom-and-doom economist Nouriel Roubini said last week.

“I thought a few months ago that the perfect storm would be 2013, but now, the economic weakness in the U.S., eurozone and U.K. is front-loaded,” he said.

“So we're going to double-dip earlier. The climax of it could be 2013 or it could be already earlier,” said Mr. Roubini, co-founder and chairman of Roubini Global Economics LLC, and a professor of economics at New York University's Leonard N. Stern School of Business.

“It depends on what policy tools are available,” he said.

With the eurozone in crisis, facing a record-high cost for insuring bank debt, there is a 60% probability that most advanced economies will fall into a recession, Mr. Roubini said.

Meanwhile, authorities are running out of options to provide emergency support, Mr. Roubini said.

“You need to restore economic growth, not five years from now. You need to restore it today,” he said.

“In the short term, we need to do massive stimulus; otherwise, there's going to be another Great Depression,” he said. “Things are getting worse, and the big difference between now and a few years ago is that this time around, we're running out of policy bullets.”

Another financial crisis “is already manifesting itself” in developed economies, Mr. Roubini said.

He said that if he had large amounts of money to invest, he would “mostly keep it in cash,” especially in dollars, as the U.S. currency tends to strengthen during financial crises.

Mr. Roubini also said that he also would favor government bonds of countries with small budget deficits and low public debt, such as Australia and Canada. He would avoid stocks and commodities.

“If we see a nasty global recession, then risky assets, starting with equities, are going to hurt, and going to hurt big-time,” he said.

Mr. Roubini predicted a bubble in U.S. housing prices before the market peaked in 2006, but his forecasts haven't all been accurate.

When the S&P 500 fell to a 12-year low March 9, 2009, he said that it probably would drop to 600 or lower by the end of that year. Instead, the U.S. equity benchmark gained 65% through the rest of 2009.

Freakonomics » Obama’s Jobs Bill: A Reasonable Plan

Here are some quick thoughts on President Obama’s jobs plan:

- It’s reasonably big, at about 3% of GDP.

- It’s reasonably front-loaded. Goldman Sachs says it will raise 2012 GDP by about 1.5%–before any multiplier effects. Moody’s chief economist Mark Zandi thinks the effect on 2012 GDP will be about 2%. Expect more estimates in the 1-3% range for 2012; smaller for 2013.

- It’s reasonably well targeted. Unemployment insurance extensions will get spent. Infrastructure money gets spent and also builds stuff. As for the payroll tax: Who knows if it gets spent, but the point is to stimulate hiring, rather than spending.

- It’s reasonably well designed. The biggest problem with a payroll tax is that firms get it even for employees already on the books. But this time, the biggest payroll tax cut is only for firms raising their payrolls. This will yield a much bigger bang-for-each-buck. Early analyses have yet to realize how important this is.

- It’s reasonably timely. The usual argument against fiscal policy is that the spending only occurs by the time the economy is booming again. There’s no chance of that occurring. Perhaps this provides the confidence boost we need to counter double-dip concerns.

- It’s reasonably well focused. Tax credits for hiring the long-term unemployed will be very helpful in preventing the current recession doing long-term harm.

- It’s reasonably clever, removing the incentive to fire people, rather than reduce hours. (aka “Job sharing”)

- It’s reasonably evidence-based. Having the unemployed talk to a jobs counselor before extending benefits can have huge effects at minimal cost.

All told, it’s a very real plan and very specific. None of this is magic: Government gets more active when the market fails, and we pay it back when the market booms. This is all standard economics. There’s no gold-buggery, voodoo austerity or laughable Laffer-y. Obama’s not making up economics, he’s using simple tools to solve the obvious problems. And with long-term real interest rates close to zero, there’s no risk of this crowding out private investment

But let’s not expect miracles. Without the plan, GDP growth was expected to be so anemic that unemployment was expected to rise through 2012–partly due to the drag of reduced government spending in coming years. Obama’s plan eliminates this fiscal drag, but the economy has still gotta get its mojo back. So perhaps the long malaise turns in to the tepid recovery. But perhaps the Fed can help, too.

The biggest risk is that this plan provides another opportunity for Congress to prove itself incapable of addressing real macroeconomic concerns. If it does, watch for confidence to plummet just as it did following the debt-ceiling madness.

As for the politics: Ask a political scientist. But I wouldn’t want to have to explain a vote against this to my constituents, who are mad as hell about unemployment.

A Switch From Coal To Natural Gas Won't Help The Climate: Study | Fast Company

Natural gas might burn much cleaner than coal, but getting it has its problems: leaky pipes. And those leaks spray gasses that are worse for the climate than carbon.

Natural gas is a hot energy commodity right now, with new drilling techniques, low prices, a big domestic supply in the U.S., and the support of people like T. Boone Pickens making it increasingly likely that the stuff will displace some of our reliance on coal and oil. But this may not be a good thing. A new study claims that a switch from coal to natural gas won't do much to quell climate change, despite many fewer emissions when you burn it. The culprit: methane leaks.

It's true that burning natural gas releases fewer greenhouse gas emissions than burning coal, but methane--a potent greenhouse gas--sometimes leaks from natural gas operations. According to a computer simulation study from the National Center for Atmospheric Research (NCAR), a partial global shift from coal to natural gas would still accelerate climate change through 2050 without methane leaks. If there are significant methane leaks, that acceleration could last until 2140. Preventing problems is a daunting task for a growing industry that has to contend with leaks from pipelines, wellheads, and more.

NCAR's study is just the latest to warn of natural gas's shortcomings. A recent Cornell study also pointed out the methane leak problem--and estimated the total methane loss range of the shale gas industry to range between 3.6% and 7.9%.

And then there is the water contamination issue. In one Wyoming town located near a drilling site, oil compounds were found in 89% of all drinking wells that were tested. Methane and 2-butoxyethanol phosphate (a fire retardant and plasticizer) were also discovered in some of the wells. That doesn't make climate change worse, but it makes it pretty hard to live.

It has long been clear that natural gas is not the panacea to our energy woes. But the latest warnings about methane leaks should remind us that natural gas may not much better than the dirtiest energy sources (like coal) available today.

During nursing school, I remember my first clinical instructor initiating us into one of the paradoxical truths of health care: “You don’t come to the hospital to sleep.”

Patients need to sleep — for emotional health, for wound healing, to maintain a strong immune system — and yet the drama of fractured and broken sleep plays out night after night in hospitals around the country.

Recently, a patient was set to be discharged the next day. But he needed a transfusion of platelets before we could remove the intravenous line that had been used to deliver chemotherapy. Thinking through the timing, the physician’s assistant realized that to get everything done, and to get the patient discharged on time, his treatment would have to start early in the morning. She scheduled the transfusion for 4 a.m, which meant the patient had to be woken at 3:30 a.m. to take the medications required before a transfusion.

For practical reasons, it made sense. But the patient didn’t see it that way.

“Can’t it be later so that I can sleep?” he asked.

I started explaining why the transfusion had to be at 4 in the morning, but the patient wasn’t buying it. A kind and gentle man, he had had enough of being woken in the middle of the night. After several weeks in the hospital, he was tired. He wanted to sleep.

And there was no way for him to doze through this particular procedure. For starters, we would turn on the lights in his darkened room, and two nurses would begin reading the medical record number on his wristband. We would take a set of vital signs, connect the platelets to his intravenous line and take another set of vitals in 15 minutes. In roughly an hour the transfusion would be over, at which time the pump would start to beep annoyingly. The nurse would disconnect the I.V. line and get another set of vitals.

But the timing of the process was dictated by the need to discharge the patient early in the morning. Delaying the platelets until 8 a.m. would mean the line couldn’t be pulled until 10 a.m. or later, delaying the discharge until at least noon.

Delaying a treatment for a few hours in exchange for needed sleep may not sound like a big tradeoff, but hospitals depend on “flow” and limiting a patient’s “length of stay.” They do this not only to accommodate new patients but also to make money. If a room that could empty at 10 a.m. does not empty until 2 p.m., that’s four extra hours a patient has to wait in the emergency department or a lengthy wait time for a patient with a scheduled admission. Perhaps more important to the hospital, a room that could be generating payment from a new patient isn’t earning anything from a patient who is simply waiting to leave.

There are other reasons nurses are continually required to wake patients in the dead of night. Doctors make rounds early in the morning, so we need to have the results of daily laboratory tests available by the time they get there. As a result, we start our “morning labs” at 4 a.m. Sometimes vital signs need to be taken every four hours to make sure a patient is stable. Antibiotics may be scheduled every six or eight hours, so we have to go into the patient’s room in the middle of the night, scan the wristband and sign on to the computer in the room before we can hang the bags that feed the I.V. line.

We try to bundle nighttime patient care, so we disturb the patient only once, but it’s not always possible. We try to be quiet, but some patients startle easily and can’t get back to sleep. Most of the time, we have no choice but to turn on a light. The alarm on the I.V. pump can wake a patient who then will need pain medication to fall asleep again.

And sometimes, even the best-laid plans for sleep can go awry. One of my patients had chronic insomnia and asked for an intravenous sleep drug at 4 a.m., hoping it would help him get four solid hours of sleep. No problem, I thought. But on my way to get the drug, another patient, who was physically big and unsteady on his feet, needed to go to the bathroom and wouldn’t use a bedpan. He also wanted his damp bed completely remade because he had been sweating during the night. I changed his linens, cleaned him up after he used the commode, and got him safely back into bed.

I was on my way to retrieve the sleep drug when a patient in another room, who was growing increasingly delirious, called out that she was going to be sick. I ran into the room, grabbed a basin and held it while I patted her back. In time the feeling passed, and she settled back into bed.

All that took 45 minutes, delaying my return to the bedside of the patient with insomnia. He was unhappy and complained to the aide, who was busily taking nighttime vitals, that I was very late, and that sleep still eluded him.

Nurses are taught to always think in terms of priorities. A patient who could fall going to the bathroom is a very high priority. Monitoring and comforting a delirious patient who is nauseated is a high priority, too. Sleep, unfortunately, has fallen far down on the list of priorities.

Is there a way to meet the many demands of the hospital system, while still giving our patients a good night’s sleep? If there is, I haven’t found it.

“Macbeth does murder sleep,’’ laments Shakespeare’s title character, realizing that killing his king did real violence to his own ability to get a good night’s rest. “Methought I heard a voice cry ‘Sleep no more!’ ” he imagines after killing King Duncan.

For hospital patients, the nurse is often the dreaded voice crying “Sleep no more!” That was certainly the case for the poor man who needed the 4 a.m. transfusion.

But at least, when it was over, he could finally leave the hospital and get some sleep.

February 16, 2011 was a day of reckoning for humankind. A new computer, appropriately dubbed “Watson,” beat the world’s best Jeopardy! players at their own game. At first blush this may not seem so surprising: after all, computers are notoriously better than humans at “recalling” factual knowledge. But Jeopardy! is a game show known for the nuance of its clues, which often contain puns, ambiguities, and other curiosities. Watson’s ability to understand and quickly respond to Jeopardy! questions thus reveals that computers have made great strides in emulating how humans think.

Watson is a computer built for a very specific purpose: to beat humans at Jeopardy!. Since his victory, pundits and IBM staffers have suggested that the technology powering Watson might have many uses—in the gaming world, for example, or improving customer service from much-maligned automated call centers. Only a week after winning the Jeopardy! title, Watson’s creators proclaimed to the annual Healthcare Information and Management Systems Society meeting that “Watson could dramatically improve health care delivery by offering, in minimal time, solutions that have a high level of certainty.” Here I propose how Watson could apply his skills in a legal environment: by helping textualists interpret statutes. New textualists believe in reducing the discretion of judges in analyzing statutes. Thus, they advocate for relatively formulaic and systematic interpretative rules. How better to limit the risk of normative judgments creeping into statutory interpretation than by allowing a computer to do the work?

This Essay considers whether judges might share the job of statutory interpretation with computers like Watson. First, it briefly lays out how new textualists approach statutory interpretation. Second, it describes how Watson’s aptitudes lend themselves to textualist-style statutory interpretation. Finally, the Essay pulls the threads together, discussing how Watson might both aid textualist interpretation and perhaps perform such interpretation on his own.

I. The New Textualist Aspiration

New textualism is a popular method of interpretation by which judges decipher statutes; perhaps its foremost proponent is U.S. Supreme Court Justice Antonin Scalia. New textualist premises and lines of reasoning about statutory interpretation have become widespread. Indeed, there is arguably a growing consensus that we (or at least judges) “are all textualists now.” Many others have outlined the key tenets of this method, so I will not spend much time doing so here. For the purposes of this Essay, there are three important elements of new textualism: its reliance on ordinary meaning (the premise), its emphasis on context (the process), and its rejection of normative biases (the reasoning). I consider each in turn.

First, new textualism begins from the premise that “the apparent plain meaning of a statutory text must be the alpha and the omega of a judge’s interpretation of a statute.” The goal of textualist statutory interpretation “is to identify the objective meaning of statutory text without regard to what any legislator intended that text to mean.” This stands in stark contrast to intentionalists, who believe that the goal of statutory interpretation should be for “courts to implement the intent of the legislature.”

Second, the new textualist process of analyzing statutes takes into account the context in which a word presents itself, including the structure and coherence of the statute. New textualists thus distinguish themselves from strict constructionists, who refuse to look at any sources outside the text of the statute. As Justice Scalia has suggested, “when you ask someone, ‘Do you use a cane?’ you are not inquiring whether he has hung his grandfather’s antique cane as a decoration in the hallway.” One can only understand that the question is asking whether the individual uses a cane for walking by considering it in context.

Finally, new textualists’ reasoning for undertaking this scheme of interpretation is to reduce the discretion that judges use when interpreting statutes. Justice Scalia warns that “the main danger in judicial interpretation . . . is that the judges will mistake their own predilections for the law.” To avoid such errors, new textualists believe that “the goal of statutory interpretation is to determine the objective meaning of statutory text.” New textualism aspires to such objectivity by advocating a relatively mechanical process of textual interpretation, divorced from the intent of Congress. Whereas traditional textualists allowed “strongly contradictory legislative history” to trump the plain meaning of a statute, new textualists believe that “statutes [should] be read with a strict literalism and with reference to well-established canons of statutory construction” because doing so will encourage Congress to draft laws more clearly in the first place. New textualists accordingly reject the use of legislative history as a means of understanding statutes. Such interpretative parsimony is a perceived strength of the new textualists’ method.

A range of critiques has been levied at new textualism. Not least, it has been accused of seeking to achieve impossible goals. After all, human judges will always begin from their own inherently subjective frame of reference. Further, one might quibble about whether the actual practice of new textualism achieves its stated goal of eliminating bias. Some purists have argued that to take seriously the goal of eliminating bias would require rejecting particular canons of statutory interpretation, such as absurd results or scriveners’ errors. This is in part because, by providing an escape hatch from strict textual meaning, such canons improperly allow judicial discretion to creep in.

My point here is not to dispute the importance or viability of new textualism as a mechanism for statutory interpretation. Rather, taking new textualism as a starting point—a goal, if you will—for understanding statutes, I query here whether humans, with all our cognitive biases and normative bents, are the actors best equipped to interpret statutes in this manner. It has long been recognized that humans draw poor causal inferences, especially when making judgments under uncertain conditions. And all humans have normative biases that can confound any effort to apply interpretative rules strictly or narrowly. This leads us to the new textualist dilemma: can humans ever really be successful textualists? To answer this question, we look to Watson for a little help.

II. “It’s Elementary, Watson”: Jeopardy! and Statutory Interpretation

Watson was designed with a single goal in mind: to beat humans at their own game, Jeopardy!. To determine whether Watson can successfully interpret statutes, one first must understand how he functions as a Jeopardy! contestant. This Part considers the obstacles Watson overcame to become Jeopardy! champion. It also investigates how Watson answers questions, in order to see whether his methods might help resolve the new textualist dilemma.

A. “Who Is . . . Watson?”

Watson is a computer system designed—as a first objective—to answer trivia questions on the game show Jeopardy!. In creating Watson, IBM began from the premise that computers are not, as a general principle, particularly good at answering even direct queries:

  Search engines don’t answer a question—they deliver thousands of search results that match keywords. University researchers and company engineers have long worked on question answering software, but the very best could only comprehend and answer simple, straightforward questions (How many Oscars did Elizabeth Taylor win?) and would typically still get them wrong nearly one third of the time.  

Worse still, to win at Jeopardy!, Watson needed to be able to answer questions where important search terms were not provided. For example, Jeopardy!’s “decomposition”-type questions require the contestant to “decompose the question into . . . two parts and [identify] answers to each one.” Often, “the answer common to both questions is the answer to the original clue.” Existing search engines like Google—which require the user to input search terms and then make use of algorithms to find instances where those terms relate most closely to one another—were ineffective at answering such questions.

This task is made even more difficult when we consider the construction of an average “question” on Jeopardy! First, unlike most trivia games, Jeopardy! provides an answer and requires players to respond with the corresponding question—a complicated twist for a computer. And second, Jeopardy! questions are replete with puns, word games, and even jokes, requiring far more layers of understanding than simple recall.

To understand how this works in practice, take a sample Jeopardy! question: “It means detestable or loathsome, though I have no beef with the snowman, myself.” Unlike most typical trivia questions, this Jeopardy! question contains no dates, facts, or even substantive knowledge. It relies instead on wordplay. You must know that a synonym for detestable is ‘abominable’ and then connect that phrase to the folklore of the snowman in the Himalayan Mountains. The average human can synthesize these streams of knowledge simultaneously, putting them together to reach the answer: “What is abominable?” But the average computer can only respond correctly if nearly the exact same question and answer appeared together in text it has learned. When I first plugged that sample Jeopardy! question into Google, the top hit (excluding the article from which I borrowed the question) was a blog post about wearing red high heels to a pig roast party.

Watson’s creators sought to design a computer system that could better approximate the human approach to asking and answering questions—both to determine the most likely answer and to express a level of confidence that the answer is correct. As IBM puts it, the goal of designing Watson was “to understand the actual meaning behind words, distinguish between relevant and irrelevant content, and ultimately demonstrate confidence to deliver precise final answers.” In February 2011, IBM declared success. During a Jeopardy! television special, Watson took on the two most decorated human Jeopardy! players of all time: Ken Jennings, who once won seventy-four straight games on the show, and Brad Rutter, the player with the all-time highest prize earnings. Watson amassed thousands of dollars in a resounding victory, which he secured even before the final round.

After the fact, some criticized Watson’s hair-trigger buzzer system, which could respond in as quickly as one-tenth of a second if he was confident in his answer. It is true that Watson beat his competitors to the buzzer in the vast majority of questions. But by any measure, Watson’s victory was decisive. Watson finished the contest with $77,147 in prize winnings. His next closest competitor, Jennings, earned only $24,000. Jennings responded graciously in the face of certain defeat, scrawling under his final answer in the contest that “I, for one, welcome our new computer overlords.”

B. How Watson Answers Questions

How did Watson achieve this resounding victory? IBM staff described the core components that enable Watson to answer Jeopardy! questions:

  Watson runs on a cluster of Power 750™ computers—ten racks holding 90 servers, for a total of 2880 processor cores running DeepQA software and storage. It can hold the equivalent of about one million books worth of information. . . .  
  When a question is put to Watson, more than 100 algorithms analyze the question in different ways, and find many different plausible answers—all at the same time. Yet another set of algorithms ranks the answers and gives them a score. For each possible answer, Watson finds evidence that may support or refute that answer. So for each of hundreds of possible answers it finds hundreds of bits of evidence and then with hundreds of algorithms scores the degree to which the evidence supports the answer. The answer with the best evidence assessment will earn the most confidence. The highest-ranking answer becomes the answer. However, during a Jeopardy! game, if the highest-ranking possible answer isn’t rated high enough to give Watson enough confidence, Watson decides not to buzz in and risk losing money if it’s wrong. The Watson computer does all of this in about three seconds.  

For Watson to successfully play Jeopardy!, his creators relied on the premise that computers are better than humans at storing data. For the Jeopardy! challenge, “the sources for Watson include[d] a wide range of encyclopedias, dictionaries, thesauri, newswire articles, literary works, and so on.” Watson can access a good proportion of knowledge in the public sphere, both colloquial and expert, and has perfect retention as long as he can access the information. He is thus well equipped to understand what information is available, and importantly, how frequently that information appears.

Watson processes this vast array of information by looking for relationships between the clue and other words; he figures out what words mean in context. Unlike previous computers, Watson can sort out the most relevant words in a clue and better target his answer. He identifies the “focus of the question,” detects relationships between words in the question, and decomposes questions into sub-questions, among other techniques. In the question about the abominable snowman, for example, Watson might downplay the closeness of words such as “loathsome,” “detestable,” and “myself”—the apparent reason why the blog post on red heels and pigs was elevated by the Google algorithm. Instead, Watson might look for the links that connect “detestable” to “snowman,” which would be far more likely to produce the right result. Even better, Watson can learn from his mistakes through trial and error; he stores incorrect answers and incorporates them into future games. This helps explain how Watson went from losing in trial Jeopardy! competitions to beating the top-ranked competitors of all time.

Finally, Watson is not subject to some key reasoning errors of humans. Of course, this is in part because Watson is subject to no normative inclinations of his own; he is only biased insofar as the human-controlled inputs fed into Watson’s memory are biased. Likewise, in contrast to humans who are notoriously poor at estimating probabilities, especially in the face of irrelevant information, Watson is able to express the probability that he is right in a systematic and quantifiable way. More specifically, Watson can estimate how likely it is that a particular answer he provides is correct and refrain from responding to a question if the likelihood is small (by refusing to buzz in). These skills, as I argue in the following Part, get to the essence of new textualist approaches to statutory interpretation.

III. Watson: The New Textualist?

Watson has many potential applications—and perhaps not just for search engines and scientists. Watson-style computers already help lawyers sift through documents in discovery and decipher patterns in clients’ activity. At least one judge already accepts that judges are “not like the supercomputer Watson. . . . [T]hey have no hope of knowing everything.” But could Watson and judges work together and revolutionize statutory interpretation? This Part considers, first, whether Watson could perform certain tasks of new textualism better than judges; and second, whether he might somehow assist (but not replace) them in performing such tasks.

A. Watson the Judge

Could Watson perform better than judges at the tasks of statutory interpretation? Each of the three elements of new textual interpretation—premise, process, and reasoning—point toward the possibility of Watson outperforming new textualist judges at their own game.

First, computers support new textualists’ premise by offering a mechanical way of determining the “ordinary meaning” of a statute. According to Merriam-Webster’s Collegiate Dictionary, “ordinary” means “of a kind to be expected in the normal order of events; routine; usual.” The common factor in each part of the definition is frequency; given a set of circumstances, the ordinary outcome is the outcome that occurs more often than other possible outcomes. Humans are flawed textualists because they have only one frame of reference: their own “ordinary” experience. Any computer is better equipped to identify the frequency with which a particular phrase occurs in common parlance.

Take a famous example: in Muscarello v. United States, the Supreme Court debated the meaning of the phrase “carries a firearm.” The majority argued that the ordinary meaning of carrying a gun included transporting it in a vehicle. The dissent disagreed, arguing that “carry” required holding a gun on one’s person. The two sides marshaled a vast array of evidence from the public domain to demonstrate that their interpretation was the most ordinary, including dictionaries, news articles, and even the Bible. Watson could have saved the Court’s law clerks a great deal of trouble. The computer would have been able to calculate how frequently the terms “carry” and “vehicle” (or their synonyms) appear together versus “carry” and “person” (or their synonyms). Thus, in at least one sense Watson is better at textualist interpretation than humans—he can not only identify ordinary meanings but can tell us just how ordinary a particular meaning is!

Watson’s superior recall is particularly important given the historical nature of statutes, meanings of which can change over time. Justice Scalia, for example, has suggested that absolute immunity for prosecutors did not exist at common law. A well-informed Watson could report back in a matter of minutes as to the likelihood that this was true. Watson even may be able to help decipher antiquated meanings on which there is no modern expertise—such as common law phrases no longer used today—by looking at the context in which such phrases were used.

This raises a second Watsonian virtue: his process of interpretation. Most computers merely isolate instances where identical words appear most closely to one another. Watson’s algorithms go a step further by distinguishing which connotation of a particular word is intended based on the particular context. Watson might not only look for words elsewhere in the statute, but could also draw from other words not in the statute to provide additional interpretative context. In the Muscarello example, there was at least one contextually-appropriate usage of “carry” that was not uncovered by either party in the litigation: whether state “carry” gun laws (for example, “open carry” and “concealed carry” gun laws) apply to vehicles. Watson could have estimated the frequency with which each connotation arises—including the state law use of “carry” not considered by the actual parties—to determine whether “carry” ordinarily encompasses transportation in vehicles.

Finally, and perhaps most importantly, Watson’s reasoning is more systematic than humans’ reasoning. Inasmuch as he makes errors, these errors are randomly distributed. His mistakes are not skewed due to political preferences, personal relationships, or other sources of human prejudice. Watson by design avoids the ideological bias of judges—which textualists so deeply fear—because, of course, he does not have any ideology of his own. These arguments are summarized in Figure 1.

B. Watson’s Limitations as a New Textualist

Despite these advantages, computers are unlikely to replace judges anytime soon. For one thing, Watson still makes mistakes at critical times. Perhaps the most amusing occurred in the very last Jeopardy! round in the competition. The Final Jeopardy category was “U.S. Cities,” and the answer was the following: “Its largest airport is named for a World War II hero; its second largest, for a World War II battle.” While both Jennings and Rutter correctly provided the question “What is Chicago?” Watson responded, “What is Toronto?????” Given that the only city named Toronto with any commercial airport is not in the United States, but in Canada, this was a baffling response.

The Toronto incident highlights that Watson cannot filter away such absurd responses on his own. Without a human to assist him, serious errors may remain. To be fair to Watson, the question marks indicate he was highly unsure about his response to the “Toronto” question; he was forced to answer the question in Final Jeopardy and wagered a low amount as a result. But this quantified uncertainty may not be useful when Watson attempts textualist interpretation. If Watson is uncertain about the “ordinary meaning” of a statute, he will not be able to refuse to buzz in. When Watson can find no clear ordinary meaning, what should he (or a judge) do then?

This suggests that the most serious critique for a Watson-led textualism is not practical but principled: at least in the tough cases, judging should contain normative as well as objective inputs. Employing Watson for statutory interpretation requires an important choice between allowing judicial decisions with random error but occasionally absurd results or allowing decisions with nonrandom, biased error. Watson could achieve the new textualists’ stated goal of determining ordinary meaning—with a dash of random error. But he could never decide, for example, that an outcome is normatively absurd. According to his computational frame of reference, any answer his algorithm spits out is the most likely accurate meaning. Do new textualists really want judicial decisions to be made based only on the frequency with which a meaning appears in Watson’s memory, especially when his certainty is low? I expect not.

C. Watson Assisting Textualists

As IBM brings Watson’s DeepQA technology to the medical community, Watson’s creators are not proposing that his algorithms could replace doctors in their entirety. More appropriately, they suggest that Watson could aid doctors in doing their job better. This also may be the most appropriate role for Watson in the judicial sphere. A Watson-type tool could bring the advantages of computer-based analysis to statutory interpretation without sacrificing the normative discretion which allows humans to “get it right” in ways that computers cannot.

One can imagine a tool into which users could input short phrases from statutes. The tool, powered by DeepQA technology, would then output the ordinary meaning of the phrase based on frequency calculations. Such a technology would create a presumption of ordinary meaning that judges would become (informally) bound to refute if they wished to stray from such meaning. Circumstances in which they might stray might include (1) a close call where two ‘ordinary meanings’ score highly; (2) an analytically dubious result accompanied by a low level of confidence (i.e., the Toronto example above); or (3) a normatively absurd result produced by the effects of the ordinary meaning, such as an excessively punitive result. This is similar to the way that judges already treat government agencies: in most cases giving them deference.

How might judges employ such a technology? One possibility is that it could serve the function of a law clerk and conduct basic research upon which judges can construct their opinions. A second possibility is that it could become a resource of the Federal Judicial Center; officials at each courthouse could get trained in the technology. Third, Watson might function usefully as a tool for the private sector. Lexis and Westlaw might purchase the rights to the technology, providing firms, universities, and judges alike with the ability to determine their own “ordinary meanings.” By providing more definitive meanings, Watson could eventually reduce litigation—if all parties agree to turn their fate over to the hands of a computer.

Conclusion

Watson achieved a great victory for computational “thinking” over human “thinking.” But he cannot yet make the normative decisions that ethical judging requires. What Watson already can do for judges is to provide a baseline against which to evaluate their own interpretations of “ordinary meaning.” Watson will not stop bias from creeping into judicial decisionmaking—but his contributions to statutory interpretation are nevertheless far from trivial.

'People Don't Realize How Fragile Democracy Really Is' - James Fallows - Politics - The Atlantic

Two days ago I mentioned the "Goodbye to All That" essay by Mike Lofgren, a respected (including by me) veteran Congressional staffer who had worked for Republican legislators on defense and budget issues for nearly 30 years.

I you have not read his essay yet, please read it now.  And then, please return!

Among the important aspects of his essay is that it goes beyond one now-conventional point of "the worse, the better" analysis: that the GOP's main legislative goal is to thwart Obama, and if that includes blocking proposals that might revive the economy, so much the better for the Republicans next year.

More fundamentally, Lofgren argues that today's Republicans believe they are better off if government as a whole is shown to fail, not just this Democratic Administration. Republican hard-liners might seem to have "lost" the debt-ceiling showdown, in that they wound up even less popular than the Democrats are. But in the long view, Lofgren says, unpopularity for anyone in Congress, including their party's leaders, helps the Republicans: "Undermining Americans' belief in their own institutions of self-government remains a prime GOP electoral strategy," because it buildings a nihilistic suspicion of any public effort, from road-building to Medicare to schools. (Except defense.) As I say, read it for yourself.

When you're done, consider this message I received today, from another former Congressional staffer whose tenure overlapped almost exactly with Lofgren's. This too is worth reading carefully, for it advances an important complementary point:

>>Like Mike Lofgren, I am a retired Congressional staffer who worked for a House Member from 1985 until January of this year. Unlike Lofgren, I did not retire voluntarily; my boss, a moderate Democrat, lost his race for re-election last November. I found myself agreeing with virtually everything in Mike's article and immediately forwarded it to a bunch of my friends, some of whom remain working on the Hill.

Privately, many of us who have worked in Congress since before the Clinton Administration have been complaining about the loss of the respect for the institution by the Members who were elected to serve their constituents through the institution. I don't think people realize how fragile democracy really is. The 2012 campaign is currently looking to be the final nail in the coffin unless people start to understand what is going on.

One thing that especially resonated with me about Mike's piece is the importance of "low information" voters. The mainstream media absolutely fails to understand how little attention average Americans really pay to what goes on in all forms of government. During our 2008 race, our pollster taught me (hard to believe it took me 24 years to learn this) that the average voter spends only 5 minutes thinking about for whom to vote for Congress. All the millions of dollars of TV ads, all the thousands of robo-calls and door-knocks, and it all comes down to having a message that will stick in the voters' minds during the 5 minutes before they walk into the voting booth.

The media likes to call this group "independents," which implies that they think so long and deeply about issues that they refuse to be constrained by the philosophy of either party. There may be a couple of people out there who fit that definition, but those are not the persuadable voters campaigns are trying to capture. Every campaign is trying to develop its candidate into an easy-to-remember slogan that makes him or her more appealing than the other guy. Actually, because negative campaigning is so effective, they are more often trying to portray the opponent as more objectionable ("I guess I'll vote for the crook because at least he won't slash my Medicare").

I'm writing because now that I have been out of the Beltway Bubble, I have gained a little more perspective on how real people see the work of Washington, and I am scared that they are close to revolt. The debt ceiling debate in particular had me screaming at the TV on more than one occasion because both sides botched it so badly. I would like to hope that news outlets like yours could play a positive role in helping to educate people. But I'm feeling pretty pessimistic at the moment.<<

'Star-Trek' sick bay detects diseases

British engineers have built a £1 million Star Trek-style 'sick bay' for the National Health Service, debuting at the Leicester Royal Infirmary's accident and emergency department.

Designed to detect everything from bruising to cancer, the unit was developed as a byproduct of a joint project with NASA aimed at detecting the presence of life on Mars.

The unit is equipped with a set of instruments which analyze a patient's breath, as well as another set that uses visual imaging to examine a patient's skin. A third suite of monitors looks inside the body and measures blood-flow and oxygenation in real-time.

The team believes the equipment can be used to diagnose over 40 diseases, from sepsis through to bacterial infections such as C. Difficile and some cancers.

It's the first time all these technologies have been brought together in an integrated way - and developing it involved scientists working in space research, emergency medicine, engineering and IT.

"We are replacing doctors' eyes with state-of-the-art imaging systems, replacing the nose with breath analysis, and the 'feel of the pulse' with monitoring of blood flow using ultra sound technology and measurement of blood oxygen levels," says professor Mark Sims, a University of Leicester space scientist.

"In the old days, it used to be said that a consultant could walk down a hospital ward and smell various diseases as well as telling a patient's health by looking at them and feeling their pulse. What we are doing is a high tech version of that in order to help doctors to diagnose disease."

Human breath contains a range of volatile organic compounds from bodily processes, whicih can be identified by a real-time mass spectrometer, and which provide clues to a wide range of diseases.

"An obvious example is ketones, which we detect in the breath of diabetics during hypoglycaemia," says Sims.

"But there are also chemicals that can or could be used to indicate conditions such as asthma, sepsis, liver disease, heart disease, and several types of cancer."

He says the same technology can be used to analyse urine and faeces.

The project came about through the development of a device called the Life Marker Chip for the ExoMars space mission, which will look for organic molecules in samples from below the surface of Mars.

Other space technology used in the project includes the imaging equipment used to gather information from patients, using visible light wavelengths as well as infra-red, and a thermal imagerthat examines patients' surface and core temperatures.

Comparing the two temperatures can reveal disease because one response to illness is to withdraw blood from peripheral parts of the body.

Meanwhile, multi-spectral and hyper-spectral imagers can detect subtle changes in skin colour, showing, for example, liver disease, shock-induced poor circulation, early stage bruising and skin cancers.

"Ultimately in the longer term we would aim to work towards something like the 'tricorder' device seen in futuristic science series like Star Trek. What we are developing so far is more like a first attempt at the medical bed in the sci-fi series," says Sims.

"It is hard to predict how this work will develop. But ten years from now it could be routine for diagnostic technology to be combined in this way."

Steven Brill has it exactly right when he says that “our nation’s economy, security, and core values depend on [the] success” of our public schools.

That’s what President George W. Bush had in mind when he signed “No Child Left Behind” into law in 2001. Signaling his strong concerns about that legislation’s shortcomings, it is also why Education Secretary Arne Duncan announced earlier this month that he would override the requirement under No Child Left Behind that 100 percent of students be proficient in math and reading by 2014.

Mr. Duncan said he is waiving the law’s proficiency requirements for states that have adopted their own testing and accountability programs and are making other strides toward better schools. Without the waivers, he said, 80 percent of American schools would get failing grades under the law.

But No Child Left Behind has an even more pernicious effect – it is discouraging the teaching of science courses, particularly at the elementary level, at a time when America needs them the most. What is more central to our current economy, security and core values than science? Where would we be without Google and Apple, stealth technology, gene-based therapy, and high-tech prosthetics?

Recent national studies show that at the elementary level, science is barely being taught. More than eight hours of instructional time are devoted each week to teaching “English Language Arts” (“ELA” is a story in and of itself) and over five hours per week to math. By comparison, science is taught for less than three hours.

The situation is worse in schools that have been identified as “in need of improvement”:  Science is entirely eclipsed by subjects that students will be tested on, and these are the very same schools that are likely to have higher levels of poor children and children of color.

A growing body of evidence indicates grade-level, high stakes testing has heavily biased schools toward teaching tested subjects and away from less frequently tested subjects like science. Further, when science is taught, students are more likely to be memorizing information and answering chapter-end questions. Students should be engaging in the kind of real-world problem-solving that employers say they want most.

We need to be wary of what might seem to be the obvious solution:  ensuring that science is tested the way math and English are. Adding more science tests will not remedy this problem anymore than testing in math and English have helped. Testing does not motivate engagement, passion, creativity and innovative thinking.

A quick look at the countries where children outperform the U.S. on the OECD Programme for International Student Assessment (PISA) shows that none of them do anywhere near the amount of testing that is done in the United States. Some of the top-performing countries do national testing, but at “gateways” only – e.g., upon leaving elementary school or entering high school. None have grade-by-grade national tests.

It is time to acknowledge that there has been an unprecedented and precipitous decline in science teaching and learning as a consequence of the focus and implementation of No Child Left Behind. We do not need any more commissions or studies to tell us what is strikingly evident — children of the NCLB era, who entered Kindergarten in 2003 and had little or no science education for the next seven years, are not going to do well in science in middle school or beyond. We are losing an entire generation to science illiteracy.

Yet science literacy is essential in the 21st century. President Obama and others have highlighted the need for improved national science education: “All American citizens need high quality STEM education that inspires them to know more about the world around them, engages them in exploring challenging questions, and involves them in high quality intellectual work.” STEM is a common abbreviation for science, technology, engineering and math.

According to a report from the Center on Education and the Workforce, there will be eight million job openings in STEM-related fields by 2018, yet the U.S. continues to lag behind in student achievement in these areas.

In 2009, PISA found that 15-year-old U.S. students ranked 17th of 34 developed countries in science and 25th of 34 in math. The same study revealed that the U.S. has among the most unequal performance in the world, with achievement levels highly dependent on socio-economic status. Low-income and minority communities are especially hard-hit by lack of access to high-quality science resources. The results from the 2009 National Assessment of Educational Progress drive home the severity of the problem – only 18 percent of New York City’s 4th graders and 13 percent of 8th graders performed at or above the proficient level in science.

Over the next six years, as “Generation NCLB” goes through high school, we can expect banner headlines about further drops in science learning and fewer students taking advanced level courses in biology, chemistry, and physics. That will be a precursor to the hue-and-cry from colleges, four years later, about the need for more remedial science and the falling number of American students majoring in sciences of all types, and then a renewed clamor from employers who need appropriately educated workers but cannot find them.

This is where our heavy-handed emphasis on grade-level high stakes testing has taken us. Unfortunately, we have successfully built a system nationwide that has led to a sustained level of decline in science learning at a time when we need it the most.

The endpoint of our current trajectory is clear, but the future could be – must be – different.

Jim Leftwich sent me the link to this excellent stop-motion recreation of the opening title sequence for Jonny Quest. Wow! In 1964, Jonny Quest aired to rave reviews as the first, adult action/adventure cartoon in prime time. It had cool jazz music by Hoyt Curtin and terrific, high contrast pen and ink design work by Doug Wildey. As an animator and long time JQ junkie, I had always wanted a set of Jonny Quest action figures but, due to high production costs, the show only lasted one season; not long enough to spawn any kind of serious toys or other merchandising tie-ins. So, almost 50 years later, I made my own. Here is my Valentine to one of the coolest, if not THE coolest, cartoons ever to spin up the imagination of a 53-year-old man now going on six. Enjoy!

“Have you left no sense of decency?” That’s the question Joseph Welch famously asked Joseph McCarthy, as the red-baiting demagogue tried to ruin yet another innocent citizen. And these days, it’s the question I find myself wanting to ask Eric Cantor, the House majority leader, who has done more than anyone else to make policy blackmail — using innocent Americans as hostages — standard operating procedure for the G.O.P.

A few weeks ago, Mr. Cantor was the hard man in the confrontation over the debt ceiling; he was willing to endanger America’s financial credibility, putting our whole economy at risk, in order to extract budget concessions from President Obama. Now he’s doing it again, this time over disaster relief, making headlines by insisting that any federal aid to the victims of Hurricane Irene be offset by cuts in other spending. In effect, he is threatening to take Irene’s victims hostage.

Mr. Cantor’s critics have been quick to accuse him of hypocrisy, and with good reason. After all, he and his Republican colleagues showed no comparable interest in paying for the Bush administration’s huge unfunded initiatives. In particular, they did nothing to offset the cost of the Iraq war, which now stands at $800 billion and counting.

And it turns out that in 2004, when his home state of Virginia was struck by Tropical Storm Gaston, Mr. Cantor voted against a bill that would have required the same pay-as-you-go rule that he now advocates.

But, as I see it, hypocrisy is a secondary issue here. The primary issue should be the extraordinary nihilism now on display by Mr. Cantor and his colleagues — their willingness to flout all the usual conventions of fair play and, well, decency in order to get what they want.

Not long ago, a political party seeking to change U.S. policy would try to achieve that goal by building popular support for its ideas, then implementing those ideas through legislation. That, after all, is how our political system was designed to work.

But today’s G.O.P. has decided to bypass all that and go for a quicker route. Never mind getting enough votes to pass legislation; it gets what it wants by threatening to hurt America if its demands aren’t met. That’s what happened with the debt-ceiling fight, and now it’s what’s happening over disaster aid. In effect, Mr. Cantor and his allies are threatening to take hurricane victims hostage, using their suffering as a bargaining chip.

Of course, Mr. Cantor would have you believe that he’s just trying to be fiscally responsible. But that’s no more than a cover story.

Should disaster aid, as a matter of sound public finance, be offset by immediate cuts in other spending? No. The time-honored principle, backed by economists right and left, is that temporary bursts of spending — which usually arise when there’s a war to fight, but can also arise from other causes, including financial crises and natural disasters — are a good reason to run temporary budget deficits. Rather than imposing sharp cuts in other spending or sharply raising taxes, governments can and should spread the burden over time, borrowing now and repaying gradually via a combination of lower spending and higher taxes.

But can the U.S. government borrow to pay for disaster aid? Isn’t the government broke? Yes, it can, and, no, it isn’t. America has a long-run deficit problem, which should be met with long-run budget measures. But it’s having no problem at all borrowing to pay for current expenses. Moreover, it’s able to borrow funds at extremely low interest rates. Notably, right now the interest rate on the benchmark 10-year U.S. government bond is only slightly more than half what it was in 2004 when Mr. Cantor felt that it wasn’t necessary to pay for disaster relief.

So the claim that fiscal responsibility requires immediate spending cuts to offset the cost of disaster relief is just wrong, in both theory and practice. As I said, it’s just a cover story for the real game being played here.

Now, Mr. Cantor may end up backing down on this one, if only because several of the hard-hit states have Republican governors, who want and need aid soon, without strings attached. But that won’t put an end to the larger issue: What will happen to America now that people like Mr. Cantor are calling the shots for one of its two major political parties?

And, yes, I mean one of our parties. There are plenty of bad things to be said about the Democrats, who have their fair share of cynics and careerists. There may even be Democrats in Congress who would be as willing as Mr. Cantor to advance their goals through sabotage and blackmail (although I can’t think of any). But, if they exist, they aren’t in important leadership positions. Mr. Cantor is. And that should worry anyone who cares about our nation’s future.
